Liability Loss:
If you are involved in an accident irresponsibly, a liability loss is existent in either case. The authors of damage or their insurances are bound to compensate the loss. In the context of the compensation there is a basic principle: The injured person is to bring in the same position as he would be in without the accident. This includes the compensation of all costs from the costs of repair, the assessor and the lawyer to the costs of a rented car and additional costs (towinig, postage, telephone, etc.).
Look at § 249 BGB (German Civil Code)
“…A person who is liable in damages must restore the position that would exist if the circumstance obliging him to pay damages had not occurred […] Where damages are payable for injury to a person or damage to a thing, the obligee may demand the required monetary amount in lieu of restoration. When a thing is damaged, the monetary amount required under sentence 1 only includes value-added tax if and to the extent that it is actually incurred…”
Partial Covarage Loss:
There are the following types of partial covarage losses:
• burglary loss
• cullet loss
• fire loss and explosion
• short-circuit loss
• storm loss
• damage by hail
• flood damages
• damages by furred game
The compensation of the loss occurs reffering to the agreements of the insurance contract. There will be no downgrade into a lower class of the so called “no-claims bonus“. Appointed co-payments and deductions “new for old” are to be considered. In case of a comprehensive insurance the scope of services of a partial coverage is included.
Comprehensive Coverage Loss:
The comprehensive insurance compensates the following types of losses including the full scope of services of a partial coverage:
• self-inflicted damages
• malicious damaging by strangers (vandalism)
Reffering to the agreements of the insurance contract the compensation of the loss will be occured. In case of the availment of a compensation by the comprehensive coverage there will be a downgrade into a lower class of the so called “no-claims bonus“. Appointed co-payments and deductions “new for old” are to be considered.
